1. Agreement
These Terms of Service ("Terms") apply when you use creationic.com or hire Creationic ("we", "us") for any service. By accepting a proposal, paying an invoice or using our website, you agree to these Terms. If a signed proposal or contract says something different, the proposal or contract wins for that project.
2. Our services
We provide branding and UI/UX design, website and WordPress development, landing pages and sales funnels, CRM and automation setup, Shopify, Webflow and Framer builds, web apps and SaaS, SEO, and ongoing monthly design and development support. The exact deliverables for your project are listed in your proposal.
3. Proposals & scope
Before work starts you'll receive a written proposal with the scope, deliverables, timeline and fixed price. Package descriptions on our website are a guide; your proposal is what we commit to. Work not listed in the proposal is out of scope and will be quoted separately before we do it.
4. Fees & payment
- All prices are in US dollars and exclude any taxes, bank or payment-processor fees.
- Fixed-price projects are usually billed 50% upfront and 50% at launch, unless your proposal sets different milestones.
- Work begins once the deposit is received. Invoices are due within 7 days.
- We may pause work, or keep a site on staging, while an invoice is overdue. Final files and full ownership transfer once the project is paid in full.
5. Monthly partner plans
Monthly, quarterly and yearly plans are billed in advance and renew automatically until cancelled. Each plan includes a set number of hours per billing period; unused hours don't carry over. You can pause or cancel anytime before the next billing date — the current period stays active until it ends and is not refunded.
6. Your responsibilities
- Provide content, brand assets, logins and feedback on time.
- Make sure you own or have permission to use everything you send us (text, images, logos, data).
- Review and test deliverables when we ask, and keep your own backups of your business data.
- Make sure your website complies with laws that apply to your business, including your own privacy policy and terms.
7. Timelines & approvals
Timelines in your proposal assume prompt feedback and content from you. Delays on your side move the schedule accordingly. If a project is paused waiting on you for more than 30 days, we may close it and invoice for work completed; restarting may be quoted as a new project. Your approval of a design or stage means we can move on to the next one.
8. Revisions & changes
Each package includes the revisions stated in it. Changes to an already-approved stage, or new features, are treated as change requests and quoted before we start them.
9. Third-party tools & hosting
Your project may use third-party platforms such as WordPress plugins, Shopify, GoHighLevel, ClickFunnels, Webflow, Framer, hosting providers or payment gateways. Their subscriptions are billed to you, their terms apply, and we are not responsible for their outages, price changes or policy changes. We recommend that you own all accounts in your name.
10. Ownership & intellectual property
When your project is paid in full, you own the final designs, content and custom code we created specifically for you. We keep ownership of our pre-existing tools, code libraries, templates and know-how, and grant you a permanent licence to use them as part of your project. Third-party items (themes, plugins, fonts, stock images) remain under their own licences.
11. Portfolio
Unless you ask us not to in writing, we may show the finished work (screenshots, a short description and a link) in our portfolio and marketing. We never share confidential information.
12. Support & warranty
We fix bugs in our own work reported within the support period included in your package (for example, 1–3 months after launch). This doesn't cover problems caused by later changes from you or others, plugin or platform updates, hosting issues or new features. After that period, support is available through a monthly plan or at an agreed rate.
13. Confidentiality
We keep your business information, logins and data confidential and use them only to deliver your project. We ask the same of you for our proposals and pricing.
14. Limitation of liability
We work carefully, but we can't guarantee specific results such as rankings, traffic, leads or sales. To the extent the law allows, we are not liable for indirect or consequential losses (such as lost profits or data), and our total liability for any project is limited to the amount you paid us for that project.
15. Cancellation & refunds
You can cancel a project at any time by email. You'll pay for work completed up to that point. Deposits cover scheduling and work already started and are non-refundable once work has begun. We may end a project if these Terms are seriously breached, refunding any payment for work not yet done.
16. Using this website
The content of this website — text, designs, graphics and code — belongs to Creationic or its clients and may not be copied without permission. Pricing on the website may change; your proposal locks in your price. Please don't misuse our forms or try to disrupt the site.
17. Governing law
These Terms are governed by the laws of Bangladesh. We'll always try to resolve any disagreement by talking first; if that doesn't work, the courts of Dhaka, Bangladesh will have jurisdiction, unless your local consumer laws give you other rights.
18. Changes to these Terms
We may update these Terms from time to time. Changes apply to new projects and orders from the date they're published; your existing proposal stays as agreed.
